California Division of Workers Compensation submits formulary regulations for final approval

The Division of Workers Compensation (DWC) appears to have submitted what is expected to be the final version of its proposed formulary rules to the Office of Administrative Law (OAL) for final approval more than 60 days prior to the January 1, 2018 effective date. The Office of Administrative Law has until December 7, 2017 to sign off on the rules. It does not appear there were substantive changes from the submitted version to the OAL and the September text as posted on the DWC site. It is not expected there will be substantive changes by the OAL as they review.

Our Government Affairs and Regulatory Implementation teams will be reviewing the proposed final version and initiating our next steps as we look forward to the implementation of the formulary on January 1, 2018.

The final rules have not been posted to the DWC website or the OAL website, but were made available through the California Workers Compensation Institute website.
