New York adopts final version of its workers’ compensation drug formulary

Info on new formulary requirements for prescription compliance forthcoming

After more than two years of rule-making activity, meetings with stakeholders and review of stakeholder comments, the New York Workers’ Compensation Board (WCB) is ready to move forward with implementation of their formulary. 

Based upon an initial review of responses to filed comments, posted in the published adoption notice – June 5, 2019 New York State Register – it appears the WCB may have made changes to the version published for comment in April 2019. However, details on changes will be better ascertained once a full version of the adopted rule is available for review on the WCB website. 

Clock is ticking on application of formulary requirements for prescription compliance

With formal publication of the adoption notice on June 5, the clock has begun ticking on moving forward with proper implementation and application of formulary requirements. Specifically, all new prescriptions should be written in accordance with formulary requirements on or after six months from the date of adoption and within twelve month from date of adoption for any refill or renewal prescriptions.

Clients urged to prepare for compliance

As this was just published, the OWCA Team has now begun a thorough analysis and will provide further information. We urge all clients to initiate any necessary steps to drive compliance with the new requirements. And as your PBM partner, we will be part of that process.
