What: Medicare Part C Conditional Payments: An Update on Medicare Advantage Plans Reimbursement Rights

When a Medicare beneficiary enrolled in Medicare Parts A and B has an accident for which he or she needs medical care, the defendant or its insurer is the primary payer for such medical care, while Medicare remains a secondary payer. If Medicare makes payment for any medical services related to that claim, Medicare is entitled to reimbursement for such conditional payments, including the potential for double damages. With more than 15 million Medicare beneficiaries, almost a third of all current Medicare recipients, giving up their Part A and B coverage, and instead turning to Part C (Medicare Advantage Plans or MAP) for coverage, are such MAP private carriers considered secondary payers? And if so, are they entitled to the same recovery rights that the federal government has, including the ability to seek double damages when primary payers deny responsibility for payment of such medical bills? This presentation will examine the evolution of regulations and case law affecting such rights. It will provide attendees with a comprehensive, up-to-date status of Part C MAP reimbursement rights.
